1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Wishy Washy LLC ("Company," "we," "us," or "our"). By accessing our website at wishywashy.app or using our mobile applications or detailing marketplace services, you agree to be bound by these Terms.

If you do not agree with any part of these Terms, you may not use our services. You must be at least 18 years of age to use our platform.

2. Description of Services

Wishy Washy LLC operates a two-sided marketplace platform consisting of the Wishy Washy customer app and the Wishy Washer contractor app. The platform connects customers seeking mobile car detailing services with independent contractor detailers ("Washers") in the Phoenix metropolitan area.

We are a marketplace, not a car wash company. Wishy Washy LLC facilitates the booking, scheduling, and payment process but does not directly employ Washers. All detailing services are performed by independent contractors.

3. Bookings & Appointments

Appointments are confirmed upon successful booking through the app or website. By booking a service, you agree to the following:

  • Provide accurate vehicle, location, and contact information at the time of booking
  • Ensure your vehicle is accessible and parked in a safe, serviceable location
  • Remove personal valuables from your vehicle prior to the appointment — Wishy Washy is not responsible for lost or damaged personal items
  • Disclose any pre-existing damage, sensitive surfaces, or special conditions at the time of booking

As a mobile service, occasional delays due to traffic or prior appointments may occur. If you require your vehicle to be completed by a specific time, note it in the appointment field when booking and we will do our best to accommodate. For time-sensitive needs, we recommend booking with extra buffer time.

Wishy Washy reserves the right to reschedule or cancel appointments due to weather, safety concerns, or circumstances beyond our control. You will be notified promptly in such cases.

4. Pricing & Payment

All pricing is displayed at the time of booking. Prices are flat-rate and inclusive of labor and standard materials unless otherwise stated. Additional charges may apply for add-on services, excessive soiling, or vehicle conditions not disclosed at booking.

  • Payment is processed securely in-app or upon service completion
  • We accept all major credit cards, Apple Pay, Google Pay, Venmo, and cash
  • All transactions are in USD
  • Gratuity is optional and never required

5. Cancellations & Rescheduling

  • Cancellations made more than 24 hours before the scheduled appointment are eligible for a full refund
  • Cancellations made within 24 hours of the appointment may be subject to a cancellation fee
  • No-shows or cancellations after the Washer has arrived will be charged the full service amount

6. Satisfaction Guarantee

We stand behind the quality of our Washers. If you are unsatisfied with a service, contact us within 24 hours and we will work to make it right — including sending a Washer back at no additional charge if necessary.

7. Washer / Contractor Terms

Independent contractor Washers who use the Wishy Washer app agree to the following additional terms:

  • Washers are independent contractors, not employees of Wishy Washy LLC
  • Washers are responsible for their own equipment, supplies, insurance, and taxes
  • Washers must maintain a valid Arizona driver's license and pass a background check
  • Washers must provide services in a professional and timely manner
  • Washers must carry their own general liability insurance (strongly recommended)
  • Washers may not solicit customers obtained through the platform for off-platform services during their tenure and for 12 months after termination
  • Wishy Washy reserves the right to suspend or terminate a Washer's account for poor ratings, misconduct, or policy violations

8. Prohibited Conduct

All users of the platform, whether customers or Washers, may not:

  • Use the platform for any unlawful purpose
  • Provide false or misleading information
  • Harass, threaten, or harm other users or Washers
  • Attempt to circumvent our platform to book or pay for services directly outside the app
  • Interfere with the operation of our platform or its infrastructure
  • Use our platform to distribute spam or malicious content

9. Limitation of Liability

To the fullest extent permitted by law, Wishy Washy LLC shall not be liable for:

  • Pre-existing vehicle damage not disclosed at the time of booking
  • Damage resulting from customer-installed aftermarket accessories
  • Actions or omissions of independent Washer contractors
  • Indirect, incidental, or consequential damages arising from use of our platform
  • Service delays caused by traffic, weather, or other factors outside our control

Our total liability to any customer shall not exceed the amount paid for the specific service giving rise to the claim.

10. Dispute Resolution

Any disputes arising from these Terms or our services shall first be addressed through informal negotiation. Contact us at support@wishywashy.app or (602) 459-7481. If a resolution cannot be reached within 30 days, disputes shall be resolved through binding arbitration in Maricopa County, Arizona, under the rules of the American Arbitration Association.

11. Intellectual Property

All content on our website and apps — including text, graphics, logos, images, and software — is the property of Wishy Washy LLC and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

12. Third-Party Services

Our platform integrates with third-party services for payment processing, scheduling, and communications. Wishy Washy LLC is not responsible for the practices, content, or reliability of third-party providers. Your use of those services is subject to their respective terms and privacy policies.

13. Privacy

Your use of our services is also governed by our Privacy Policy, which is incorporated by reference into these Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to conflict of law principles. Any legal proceedings shall be brought in the courts of Maricopa County, Arizona.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the "Last updated" date at the top of this page. Continued use of our services after changes are posted constitutes acceptance of the updated Terms.
